Read the Privacy Policy.
These Terms of Use (“Terms”) are a binding agreement between you and Bread2Door (“Bread2Door,” “we,” “us,” or “our”) governing your access to and use of bread2door.com and services that link to these Terms (collectively, the “Services”). Our Privacy Policy explains how we handle personal information.
By accessing or using the Services, or by clicking to accept these Terms, you agree to them. If you do not agree, do not use the Services.
1. Eligibility and authority
You must be at least 13 years old to use the Services. If you are under 18, you may use them only with the involvement and permission of a parent or legal guardian who agrees to these Terms. If you use the Services for a business or organization, you represent that you have authority to bind it, and “you” includes that entity.
2. What Bread2Door provides
Bread2Door helps people discover breads and bakeries, view estimated or reported bake windows and freshness information, express pilot interest, and submit pickup or delivery requests. Features vary by location and stage of launch.
Bread2Door is a technology and coordination service. Unless we expressly say otherwise, Bread2Door does not bake, manufacture, package, label, or independently inspect food. Bakeries are responsible for their products, descriptions, ingredients, preparation, food safety, availability, and regulatory compliance. A delivery provider is responsible for the delivery services it independently performs.
3. The present pilot is request-only
During the current pilot, a submission is an expression of interest or request. It is not an accepted order, reservation, promise of availability, or contract for sale or delivery. No payment is taken through the current pilot. A request becomes binding only if the applicable checkout or confirmation flow clearly identifies the seller, items, price, fees, fulfillment method, and acceptance.
4. Accounts and accurate information
No account is currently required to browse, join the pilot, or submit a request. Operator and partner sign-in exists for people Bread2Door has already given an account. If account features are introduced more broadly, you must provide accurate information, keep credentials confidential, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account except to the extent caused by Bread2Door's breach of these Terms or applicable law.
You agree that request, delivery, and contact information you provide is current, complete, and accurate. You may not impersonate another person, use information you are not authorized to use, or submit fraudulent or disruptive requests.
5. Availability, bake windows, and freshness
Bakery hours, item listings, bake windows, stock, and freshness indicators may be based on bakery reports, public information, estimates, or recent observations. They can change without notice. Labels such as “likely fresh,” estimated bake times, photographs, and descriptions are informational and are not guarantees that an item is available, hot, warm, recently baked, identical to an image, or suitable for you.
We use “hot” or equivalent confirmed language only when the bakery has confirmed it, but conditions can still change between confirmation and pickup or delivery.
6. Orders, prices, and payment if commerce is enabled
If Bread2Door later enables checkout, the order screen will identify the items, seller or merchant of record, price, applicable taxes, service or delivery fees, tips, and material terms before you submit. Prices and availability remain subject to confirmation. An automated acknowledgment means we received an order; it does not necessarily mean the seller accepted it.
You authorize the disclosed payment processor to charge the selected payment method for accepted orders and any clearly disclosed amounts. You represent that you are authorized to use that method. Taxes, fees, refunds, credits, substitutions, and cancellations will follow the policy displayed at checkout and applicable law.
7. Changes, substitutions, cancellation, and refunds
Perishable food and bakery production are time-sensitive. If an item is unavailable, the fulfillment party may offer a substitution or cancellation. No substitution should be charged without the consent required by the checkout flow. Once preparation begins, cancellation or refund rights may be limited, except where required by law or where an item is wrong, missing, unsafe, or materially different from what was accepted.
Payment will not be enabled until a specific cancellation, refund, substitution, fee, tax, tip, and chargeback policy appears at checkout and in the confirmation receipt.
8. Pickup and delivery
You are responsible for selecting the correct location and fulfillment method, providing safe and complete delivery instructions, being available during the stated window, and collecting perishable items promptly. Estimated times are not guarantees. Traffic, weather, bakery production, demand, access problems, and events outside reasonable control may cause delay or cancellation.
Risk of loss and responsibility for an order pass as stated at checkout and under applicable law. If no specific rule is displayed, responsibility ordinarily passes when the order is delivered to the address or handed over at pickup, except for loss or damage caused by the responsible seller or delivery provider.
9. Ingredients, allergens, dietary needs, and food safety
Food may contain or come into contact with wheat, gluten, milk, eggs, soy, sesame, peanuts, tree nuts, and other allergens. Ingredient, allergen, vegan, vegetarian, kosher, halal, organic, or similar information is supplied by bakeries or other sources and may be incomplete, outdated, or affected by shared equipment and facilities.
Do not rely on the Services for a serious allergy or medical dietary need. Contact the bakery directly before ordering or consuming a product. If you have a life-threatening allergy, the Services may not be appropriate for you.
Inspect food upon receipt and follow storage and handling instructions. Do not consume food that appears contaminated, spoiled, tampered with, or improperly handled. Contact the bakery and Bread2Door promptly about a suspected safety issue. In an emergency, contact local emergency services. Allergy and food-safety reports can be sent to [email protected].
10. Bakery and third-party responsibility
Bakeries and third-party providers are independent businesses, not Bread2Door employees, agents, joint venturers, or franchisees, unless expressly stated. They control their products and independent services. Bread2Door may facilitate communication or support, but does not guarantee a bakery's licenses, insurance, representations, conduct, product quality, or legal compliance.
Nothing in these Terms excludes responsibility that applicable law does not allow a party to exclude. Bread2Door may take reasonable steps to investigate reports, correct listings, suspend a partner, or cooperate with authorities, but is not required to resolve every dispute between a user and a third party.
11. Acceptable use
You may use the Services only for lawful, personal, or authorized business purposes. You may not:
- violate law, another person's rights, or a third party's terms;
- submit false, deceptive, abusive, harassing, discriminatory, or unlawful content or requests;
- interfere with security, access controls, rate limits, servers, networks, or another user's experience;
- introduce malware, scrape or harvest personal information, or use automated means to access the Services without our written permission, except ordinary search-engine indexing;
- reverse engineer, decompile, copy, frame, mirror, resell, or exploit the Services except as law expressly permits;
- use the Services to benchmark, train, or develop a competing model, database, marketplace, or product without our written permission; or
- place fraudulent requests, misuse promotions, evade fees, or manipulate ratings, availability, listings, or freshness information.
We may investigate suspected violations and suspend or terminate access, remove content, preserve evidence, or cooperate with lawful requests. Enforcement decisions do not create an obligation to monitor all activity.
12. Ownership and license
The Services, including their software, design, text, curation, compilation, graphics, logos, trademarks, and other content, are owned by Bread2Door or its licensors and are protected by intellectual-property laws. Subject to these Terms, Bread2Door grants you a limited, revocable, non-exclusive, non- transferable license to access and use the Services for their intended purpose.
Bakery names, logos, photographs, and product information may belong to the relevant bakery or other rights holder. No license is granted to use any mark except as necessary to identify the service or product presented.
13. Your content and feedback
You retain ownership of content you submit. You grant Bread2Door a worldwide, non-exclusive, royalty- free license to host, store, reproduce, display, adapt, and transmit it only as reasonably necessary to operate, improve, secure, and promote the Services in accordance with the Privacy Policy. You represent that you have the rights needed to submit that content.
If you send ideas or feedback, you allow Bread2Door to use them without restriction or compensation, and without an obligation to treat them as confidential, unless we separately agree in writing.
14. Third-party services and links
The Services may display or link to bakery sites, mapping tools, videos, social platforms, payment processors, delivery providers, and other third-party services. Third parties may impose separate terms and privacy policies. Bread2Door does not control and is not responsible for third-party content, availability, security, or conduct. A link or listing does not imply endorsement.
15. Communications
You agree that we may send electronic communications about the Services, requests, security, and these Terms. You may opt out of promotional email through the message's unsubscribe link. Bread2Door does not currently send a promotional mailing list or promotional text messages.
If you choose text for a Fresh Alert or bakery waitlist, you agree to receive service texts about that request. Message frequency follows bakery freshness updates. Message and data rates may apply. You can stop those texts by removing the alert or emailing [email protected]. Choosing text is separate from accepting these Terms. You are responsible for carrier or data charges.
16. Suspension, termination, and service changes
You may stop using the Services at any time. We may suspend or terminate access, remove content, refuse or cancel requests, or limit features if we reasonably believe you violated these Terms, created risk or legal exposure, engaged in fraud or abuse, or if doing so is necessary to protect the Services or others.
We may change, pause, or discontinue some or all Services. Where reasonable, we will provide notice of material changes affecting accepted orders or paid features. Sections that by their nature should survive termination will survive, including ownership, disclaimers, liability limits, indemnity, dispute terms, and general provisions.
17. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” BREAD2DOOR DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, QUIET ENJOYMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
BREAD2DOOR DOES NOT WARRANT THAT THE SERVICES, LISTINGS, BAKE WINDOWS, FRESHNESS INDICATORS, REQUESTS, DELIVERIES, OR THIRD-PARTY PRODUCTS WILL BE ACCURATE, AVAILABLE, TIMELY, SAFE, SECURE, UNINTERRUPTED, ERROR-FREE, OR SUITABLE FOR ANY DIETARY OR MEDICAL NEED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE TERMS MAY NOT APPLY TO YOU.
18. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BREAD2DOOR AND ITS OWNERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR BUSINESS OPPORTUNITY; OR THE COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) US$100 OR (B) THE AMOUNT YOU PAID TO BREAD2DOOR FOR THE SERVICES GIVING RISE TO THE CLAIM DURING THE SIX MONTHS BEFORE THE EVENT THAT FIRST GAVE RISE TO LIABILITY.
These exclusions and limits apply to all theories of liability and even if a remedy fails of its essential purpose. They do not limit liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, violation of statutory consumer rights, or any liability that cannot lawfully be limited or excluded.
19. Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless Bread2Door and its owners, affiliates, officers, directors, employees, contractors, licensors, and service providers from claims, losses, liabilities, damages, judgments, awards, costs, and reasonable attorneys' fees arising from or related to: (a) your unlawful or unauthorized use of the Services; (b) your content; (c) your material breach of these Terms; or (d) your violation of another person's rights.
This obligation does not apply to the extent a claim results from Bread2Door's own negligence, willful misconduct, or violation of law. Bread2Door may control the defense of a covered claim, and you will reasonably cooperate. You may not settle a claim in a way that admits liability by Bread2Door or imposes obligations on Bread2Door without our written consent.
20. Informal resolution
Before filing a claim, you and Bread2Door agree to send a written notice describing the claimant, facts, legal basis, requested relief, and a good-faith settlement proposal. Send notice to [email protected] with the subject “Notice of Dispute.” The recipient will have 30 days to respond. Any applicable limitation period will be tolled during that 30-day period. This step is not required for urgent injunctive relief.
21. Binding individual arbitration
Except for the exclusions below, any dispute arising out of or relating to the Services, these Terms, or your relationship with Bread2Door that is not resolved informally will be resolved by binding individual arbitration, not in court, under the Federal Arbitration Act. The arbitration will be administered by the American Arbitration Association under its applicable Consumer Arbitration Rules. If those rules conflict with these Terms, these Terms control to the extent permitted.
A single neutral arbitrator may award the same individual remedies a court could award, but only to the extent necessary to resolve the individual claim. The arbitrator will issue a reasoned written decision. Hearings may occur by video, telephone, written submission, or in the county where you live, consistent with applicable rules. Bread2Door will pay fees it is required to pay under applicable consumer rules, and fee shifting remains available where law permits.
Exclusions. Either party may bring an individual claim in small claims court; seek temporary or preliminary injunctive relief to protect intellectual property, security, or confidential information; or pursue public injunctive relief in court where applicable law prevents that claim from being arbitrated. Government agencies may pursue available remedies.
22. Class and jury trial waivers
YOU AND BREAD2DOOR AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, REPRESENTATIVE, OR PRIVATE-ATTORNEY-GENERAL ACTION, EXCEPT WHERE LAW MAKES THIS WAIVER UNENFORCEABLE. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS WITHOUT ALL PARTIES' CONSENT. FOR CLAIMS PROPERLY IN COURT, EACH PARTY WAIVES A JURY TRIAL TO THE EXTENT PERMITTED BY LAW.
23. Right to opt out
You may opt out of Sections 21 and 22 within 30 days after first accepting these Terms. Email [email protected] with the subject “Arbitration Opt-Out” and include your name, the email used with Bread2Door, and an unambiguous statement that you opt out. Opting out will not affect other Terms or your ability to use the Services.
24. Governing law and court venue
These Terms are governed by the Federal Arbitration Act and, to the extent state law applies, the laws of the State of California, without regard to conflict-of-law principles. If a dispute is not subject to arbitration, the parties consent to exclusive jurisdiction and venue in the state or federal courts located in Orange County, California, except that an individual eligible claim may be brought in small claims court and applicable consumer law may provide another required forum.
25. Changes to the Services or Terms
We may update these Terms from time to time. We will post the revised Terms, update the effective date, and provide additional notice when required. Changes apply prospectively. If a material change affects an existing paid service or meaningfully reduces your rights, we will provide reasonable advance notice and request renewed acceptance where required. Continuing to use the Services after the effective date of a notified update constitutes acceptance to the extent permitted by law. Earlier published versions stay available at their dated URL.
26. General provisions
- Entire agreement. These Terms, the Privacy Policy, and any terms shown at checkout or for a specific feature form the entire agreement about the Services and replace prior discussions on that subject.
- Order of precedence. Specific written terms for a transaction or feature control over these general Terms if they conflict.
- Severability. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remainder will remain effective. If the class waiver is found unenforceable for a particular claim, that claim must proceed in court unless the parties agree otherwise.
- No waiver. Failure to enforce a provision is not a waiver. A waiver must be written and applies only to the stated instance.
- Assignment. You may not assign these Terms without our consent. Bread2Door may assign them in connection with a reorganization, financing, merger, acquisition, or sale of assets, subject to law.
- No third-party beneficiaries. These Terms do not create rights for third parties.
- Electronic communications. You consent to receive agreements and notices electronically and agree they satisfy writing requirements, subject to applicable law.
- Force majeure. Bread2Door is not liable for delay or failure caused by events beyond reasonable control, except for obligations that law does not permit us to excuse.
